Non-Compete Agreements and Enforcement

Florida law requires non-compete agreements be in writing and signed by the person against whom they are enforced. An oral non-compete agreement or oral amendment to such an agreement is not enforceable. In Florida, enforcement by employers against former employees non-compete and non-solicitation agreements is not without statutory limits. Shareholder and partner disputes arise for countless reasons, from a falling out between partners over compensation to the breakup of a company following the admission of fraud by a controlling owner. Replevins, Foreclosures and Lien Litigation

We handle foreclosures of mortgages, replevins of vehicles and other equipment, and lien litigation. In foreclosures, we review the claim with applicable statutes and assist clients in compliance and work closely with clients when bankruptcy-related foreclosure issues arise. We also handle post-foreclosure evictions and assist in loan work-outs involving real estate. We represent creditors in consumer loans as well as commercial lenders in commercial collateral disputes. We also represent contractors, subcontractors, suppliers and design professionals in resolving collection and other disputes in the construction industry.

Landlord/Tenant Disputes

We represent commercial and residential landlords on a wide variety of matters, including eviction actions and disputes over the breach and interpretation of lease provisions.
